Steps In Hiring Workers

The Philippine Overseas Employment Administration or POEA is a government agency which functions as overseer of overseas employment program of the Philippines. It’s core functions are industry regulation, employment facilitation, workers protection, and general administration and support services.

Under the Overseas Employment Program, Filipinos who want to work abroad must go through documentation process in POEA. Likewise, the employer hiring the Filipino must also be registered and approved by POEA.

If you are an employer who seeks to hire Filipino workers, there are rules and regulations that you need to comply with.

1. FIND A LICENSED RECRUITMENT OR EMPLOYMENT AGENCY in the country AND GET ACCREDITED WITH THEM.

Licensed Philippine Recruitment Agencies are the only authorized bodies to conduct any canvassing, recruiting, hiring, advertising, placement and deployment activity for the foreign employer. The purpose of this is to defer any instances of human trafficking.

This means that a foreign employer cannot deploy a worker to his country without processing through a licensed Philippine recruitment agencies with some exemptions extended to the member of the diplomatic corps, international organizations, and heads of state and government officials with the rank of at least deputy minister.

Therefore, all foreign companies who wish to employ skilled or unskilled Filipino workers need to find and get accredited with a reputable licensed agency in order to recruit, interview, and hire Filipino employees.

The agency will also facilitate the documentation of the workers, and the registration of the foreign company in the Philippine Overseas Employment Administration (POEA), a government office under the Department of Labor and Employment.

2. COMPLETE THE DOCUMENTARY REQUIREMENTS TO BE SUBMITTED TO POEA.

Before a foreign employer or agency can deploy Filipino workers into his or her company, they must first be registered in the Philippine Overseas Employment Administration by the Philippine Recruitment Agency.

The documents submitted to POEA must first be verified by the Philippine Overseas Labor Office (POLO) operating in its jurisdiction. In some cases where a POLO is not present in the country, documents shall be submitted to the Philippine Embassy or Consulate for verification.

For this purpose, verification shall refer to the procedure being conducted or applied by the Labor Attaché to ensure that all the employment rights, benefits and welfare of Filipino migrant workers at the worksite are duly protected. The Labor Attaché shall also ensure that the employment contracts of Overseas Filipino Workers are consistent with the prevailing employment laws, standards and practices in both the Philippines and the host country, and that the documentary requirements for overseas employment as required by the POEA are complied with.

A checklist of standard documents will be furnished to you by the Philippine Recruitment Agency. The required documents are as follows:

  1. Copy of the foreign company’s business registration or commercial license
  2. Manpower request letter indicating the positions, no. of requirements, and basic salary
  3. Special Power of Attorney issued in favor of the Philippine Recruitment Agency
  4. Recruitment Agreement between the foreign company and the Philippine Recruitment Agency
  5. Standard Employment Contract with signature of the authorized representative of the foreign company in every page

3. SUBMISSION OF DOCUMENTS THROUGH THE PHILIPPINE RECRUITMENT AGENCY.

Send the verified documents to the recruitment agency in the country. Your Philippine agent will then lodge the documents to the POEA for processing which involves evaluation, approval, and encoding in the system. Turnaround time will depend on POEA workload.

4. APPLY FOR THE WORK PERMIT OR VISA OF THE SELECTED WORKERS

A work visa or permit should be readily available to be submitted, along with the documentary requirements, to the POEA during initial registration. This means most stages of the recruitment cycle were already performed even before the foreign employer gets accredited by the agency.

5. OVERSEAS EMPLOYMENT CERTIFICATE

When your company is finally registered, the Philippine Recruitment Agency will then apply for the workers’ Overseas Employment Certificate or OEC. This document serves as an exit clearance and certifies the regularity of a worker’s recruitment and documentation, and ensures exemption from travel tax and airport terminal fee. It is presented at the POEA Labor Assistance Center (LAC) and the Bureau of Immigration (BI) counter at the airports prior to departure. The OEC serves as the worker’s guarantee that he/she is covered by government protection and benefits.
